Terms of Service

These Terms are provided by Lone Star Outdoor Marketplace LLC ("we," "us," "the Company") and govern use of fishtexasnow.com and hunttexasnow.com (together, the "Site"). By creating an account, booking a trip, or listing a trip as a guide, you agree to these Terms.

1. Who we are

fishtexasnow.com and hunttexasnow.com are operated by Lone Star Outdoor Marketplace LLC, a Texas limited liability company. We are not affiliated with, endorsed by, or a part of the State of Texas or any Texas state agency. We operate a marketplace that connects anglers and hunters ("Customers") with independent, third-party fishing guides and hunting outfitters ("Guides") who list and conduct trips on the Site.

We are not a guide service. We do not employ, supervise, train, license, or insure any Guide, and we are not a party to the actual guiding services agreement between a Customer and a Guide. Guides are independent businesses solely responsible for the trips they list and conduct.

2. Accounts & eligibility

You must be at least 18 years old to create an account, book a trip, or list a trip as a Guide. A minor may participate in a trip only if booked and accompanied by a parent or legal guardian who accepts these Terms on the minor's behalf.

You're responsible for keeping your account credentials confidential and for all activity under your account. Guest checkout is available for booking a trip without creating an account; the same Terms apply either way.

Guide accounts start in a pending status and require our approval before a Guide may list trips or accept bookings. Approval is not a guarantee, endorsement, or verification of a Guide's licensing, insurance, skill, or safety practices — see §5 and §6.

3. Bookings & payment

Trips are booked and paid for online through the Site. Payment is required to confirm a booking and is processed by Stripe (card, Apple Pay, Google Pay, Cash App Pay where available); guide sponsor placements may also use PayPal or Venmo. We do not store your full card number or bank account details — that information is handled entirely by our payment processors.

We charge Guides a flat platform commission (currently 17% of the trip total) on confirmed bookings; the Guide receives the remainder directly to their connected payment account. New Guide accounts receive a limited number of commission-free bookings as an introductory offer, which may change or end at any time. Current commission and fee terms are also described in our FAQ, which is incorporated into these Terms by reference for pricing details, but these Terms control in the event of a conflict.

No circumventing the platform. Customers and Guides may not use information obtained through the Site to arrange a trip and pay for it outside the Site in order to avoid platform fees. We may suspend or terminate accounts that do this.

4. Cancellations & refunds

Cancellation and rescheduling of a confirmed, paid booking is handled by the Guide through the Site. If a Guide cancels a paid booking, the Customer is refunded in full to their original payment method automatically. A Guide may instead reschedule a booking to a different open date on the same trip rather than cancelling it.

We are not responsible for a Guide's decision to cancel or reschedule a trip, including for weather, safety, equipment, or availability reasons, and we do not guarantee that a trip will occur as scheduled.

5. Guides & outfitters

Guides represent and warrant that they hold all licenses, permits, registrations, and insurance required by law to operate the trips they list — including, where applicable, U.S. Coast Guard licensing, Texas Parks and Wildlife Department guide/outfitter licensing, vessel registration, and hunting-lease or land-access rights. We do not independently verify these credentials, and listing or approval on the Site is not a representation that a Guide is properly licensed or insured.

Guides are independent contractors, not employees, agents, joint venturers, or partners of the Company. Guides are solely responsible for the safe and lawful conduct of their trips, their equipment, and compliance with all applicable fishing and hunting regulations.

6. Assumption of risk

Fishing and hunting activities booked through the Site — including boating, wading, handling of fishing tackle, and the use of firearms, bows, and other hunting equipment — carry inherent risks of injury, illness, property damage, or death, whether or not caused by negligence. By booking or participating in a trip, you voluntarily assume all such risks.

We do not guarantee any particular catch, harvest, or outcome from a trip. Trip descriptions reflect what a Guide typically offers, not a promise of results.

7. Prohibited conduct

You agree not to:

  • Provide false information when creating an account or listing a trip
  • Use the Site for any unlawful purpose, including hunting or fishing without required licenses, tags, or permits
  • Harass, threaten, or discriminate against another user
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Site or other users' accounts
  • Post false, defamatory, or misleading reviews or listings
  • Circumvent platform fees as described in §3

We may suspend or terminate any account, remove any listing, or cancel any booking that we reasonably believe violates these Terms or applicable law.

8. Reviews & content

Customers who complete a booking may leave a review of their Guide. Reviews must be honest, based on an actual experience, and must not contain unlawful, defamatory, or harassing content. We may remove reviews or other user-submitted content that violates these Terms, and we are not responsible for the accuracy of user-submitted content.

By submitting a review, photo, or other content to the Site, you grant us a non-exclusive, royalty-free, worldwide license to display and use that content in connection with operating and promoting the Site.

9. Intellectual property

The Site, including its design, text, graphics, and software, is owned by the Company or its licensors and is protected by intellectual property law. You may not copy, modify, or create derivative works from the Site except as necessary to use it as intended.

10. Disclaimers & limitation of liability

THE SITE AND ANY TRIPS BOOKED THROUGH IT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY GUIDE'S SERVICES WILL MEET YOUR EXPECTATIONS.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY IS NOT LIABLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM A TRIP CONDUCTED BY A GUIDE, INCLUDING LOSSES CAUSED BY A GUIDE'S NEGLIGENCE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE IS LIMITED TO THE AMOUNT OF PLATFORM FEES WE RECEIVED FROM THE BOOKING GIVING RISE TO THE CLAIM.

You agree to indemnify and hold the Company harmless from any claim arising from your use of the Site, your violation of these Terms, or a trip you booked or conducted through the Site.

11. Disputes & governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be resolved exclusively in the state or federal courts located in Texas, and you consent to that jurisdiction and venue.

12. General

We may update these Terms from time to time; continued use of the Site after an update constitutes acceptance of the revised Terms. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
